Gastric Felony


A 13 year old middle schooler in Albuquerque, New Mexico was arrested at the behest of his school for burping in gym class. The boy was taken to juvenile detention after the arrest and was summarily suspended for the remainder of the school year. The Cleveland Middle School Principal. a teacher and a city cop are named in a civil rights lawsuit filed by the boy's parents.

No, it was not a felony, that is just a creative title. It sounds like they had it in for the boy because earlier in the year he had $200 on him so they accused him of selling pot and strip searched him. His parents were not called then either and five adults were present while he was made to strip down to underwear. No charges were filed. Seems like they were pissed about being wrong before and decided to get him for anything they could. Suspended for the rest of the school year for burping? Really?

Once again, and as usual, the story starts in the middle, sensationalizes a single moment in time and ignores any back-story that would (at least partially) explain such outrageous actions.

That way we could vilify those clowns more better!

The handcuffing thing.... really not enough info!

You can't seriously think that this is over one burp in PE class! The family can talk all they want and the school must remain silent or be sued. By the way, it never says the school handcuffed the child to a chair. An officer can handcuff you at any time if he is worried about his safety or the safety of those around you. I'm guessing the kid was handcuffed to a chair because they didn't want to throw him in the lock up with the adults at the jail. Lesser of two evils.

And for added effect, they show a picture of a guy that is handcuffed, and seems to be shirtless. Great choice of pictures to go with a story about a middle schooler...

I swear the goal is to make sure every child has a record by graduation. No child left behind, they are all in juvvie.

Agreed, Patty, and if juvenile probation were effective at all, it might work. But again the forces of local budgets, and the belief that children are able to respond to an adult system of discipline, (e.g.-waiting forever for punishment), as opposed to swift retribution, which is the only thing that children truly understand and respond to, leaves us with the same dilemma. Parents are now deemed incompetent to discipline their children without being abusive, but the state is incompetent to manage it for them. So the result is that kids literally either get away with murder, or are severely punished for just being kids. Our entire system of "acceptable" child discipline has become wholly insane and unworkable. And this issue should be at the front steps of the Supreme Court.

I still think all kids should be consigned to some island until they've reached the age of adulthood where they can be plucked off the beach and sent to training camp be fore being turned loose upon the general population!
